Terms of Service

All content on the Services, including text, graphics, images, videos, schedules, rosters, and other materials ("Materials"), is owned or licensed by BYFC unless otherwise noted. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works, transmit, or otherwise use any Materials except for your personal, non-commercial use in connection with BYFC programs.

BYFC grants you a limited, revocable, non-exclusive license to access and use the Services solely for personal, non-commercial purposes related to participating in or supporting BYFC activities. This license does not include rights to:

• Use the Services or Materials for any commercial purpose (including marketing or selling);
• Frame, mirror, or embed any portion of the Services;
• Systematically collect or scrape data;
• Modify, adapt, or reverse engineer any part of the Services;
• Remove any copyright, trademark, or other proprietary notices.

Any unauthorized use automatically terminates this license and may violate copyright, trademark, or other laws.

"Burnet Youth Football & Cheer," "BYFC," the bulldog logo (if applicable), and related names and logos are trademarks of BYFC. You may not use them without our prior written permission. All other trademarks are the property of their respective owners.

You are solely responsible for your conduct and any content you submit (including on behalf of your child). You agree not to:

• Post or transmit defamatory, abusive, harassing, threatening, obscene, pornographic, illegal, or otherwise objectionable content;
• Infringe any third-party rights (copyright, privacy, publicity, etc.);
• Post personal or financial information of others without permission;
• Engage in commercial activity, spam, solicitation, or advertising unrelated to BYFC;
• Interfere with the Services or other users;
• Upload viruses, malware, or harmful code;
• Exploit or harm children (including violating COPPA);
• Violate any applicable law or regulation;
• Create false accounts or engage in fraudulent activity.

BYFC reserves the right (but has no obligation) to monitor, edit, or remove content and to suspend or terminate your access at any time for any reason, without notice or liability.

Safety Note: Skills, drills, or other athletic content provided through the Services is for informational purposes only. You (and your child's coach or guardian) are solely responsible for determining whether any activity is safe and appropriate. Always use proper equipment, supervision, and qualified instruction. BYFC is not liable for any injury or damage resulting from use of such content.

Registration and other fees are posted on the Services and subject to change. BYFC uses third-party payment processors (Stripe or Venmo) to handle payments. These processors are responsible for securely processing your payment information. BYFC does not store your full credit card, debit card, or bank account details.

You agree to provide accurate billing information and to pay all applicable fees. All payments are non-refundable unless otherwise stated in a specific program policy. You are responsible for any taxes, levies, or duties.

The Services and all Materials are provided "as is" and "as available" without warranties of any kind, express or implied. BYFC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, BYFC and its officers, directors, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Services is to stop using them. In no event shall BYFC's total liability exceed the amount you paid to BYFC in the twelve (12) months preceding the claim.

Important – Youth Sports Risks: Participation in youth football and cheer involves inherent risks of injury, including serious injury or death. By registering or participating, you acknowledge these risks and agree that BYFC is not liable for any such injuries except in cases of gross negligence or willful misconduct (to the extent required by Texas law). Separate liability waivers may be required for participation.

You agree to indemnify and hold harmless BYFC, its officers, directors, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms;
• Your (or your child's) participation in BYFC activities;
• Any content you submit; or
• Your violation of any law or third-party rights.

BYFC may update these Terms at any time. We will post the revised version with a new effective date. Your continued use of the Services after changes constitutes acceptance of the updated Terms. Review them periodically.

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Burnet County or Travis County, Texas. You consent to the personal jurisdiction of such courts.

• Passwords/Accounts: You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
• Children Under 13: Parents or legal guardians must supervise and authorize any use by children under 13.
• Severability: If any provision is held invalid, the remainder remains in effect.
• No Waiver: Failure to enforce a provision does not waive it.
